The Expropriation Bill that will be considered by the National Assembly at the end of this month is possibly the most serious challenge yet to the agreements on which the new South Africa was established. In terms of those agreements - which are articulated in the 1993 and 1996 constitutions - the National Party government exchanged its overwhelming monopoly of power for a genuine non-racial democracy - on condition that the reasonable rights of its constituency and genuine democratic institutions would be protected by a strong and justiciable Constitution and Bill of Rights. |

Speakers at eh conference included Adv Nikki de Havilland of the Centre for Constitutional Rights, Theo de Jager of AgriSA, Ulrich Joubert former head of the Afrikaanse Handelsinstituut and Chief economist of Transnet, Dr Leon Louw of the Freemarket Foundation and Dr Lawrence Schlemmer.

The New Expropriation Bill: Wider Implications
The land and property Expropriation Bill currently before Parliament will ultimately have to be referred to the Constitutional Court for judicial review. What the Court may decide cannot be predicted, but this Bill certainly appears to be in conflict with the spirit of the Constitution. It is this feature, and the motivations of the Minister of Land Affairs in tabling the Bill, that do more damage to the as yet unstable foundations of unity and reconciliation in South Africa than any possible benefits that could flow from the controversial legislation. |

The decision today is of historic importance to South Africa since it will clearly have a major impact on the leadership of South Africa for the next five to twelve years. Ian Douglas Smith: Obituary for Newsweek Magazine
I did not really know Ian Smith personally. During the period when he was leading ‘Rhodesia’ to unilateral independence in 1965 I was a lawyer in the industrial town of Vereniging, near Johannesburg. In the early 70s, when he was manoeuvring against successive British Governments to gain recognition for his UDI, I was a back bencher and later Minister in portfolios that kept me far from our growing entanglement with Rhodesia. However, like most South Africans I closely followed Ian Smith’s actions and decisions since they so often had substantial implications for our own strategic and economic interests. |

Statement by the FW de Klerk Foundation on 'Operation Marion' and the failed SADF Raid against a supposed APLA target in Transkei
Media reports emanating from Eugene De Kock have drawn attention once again to the failed SADF raid against a supposed APLA target in October 1993. They have been presented as though they are a “revelation” and as though they provide evidence that Mr De Klerk did, in fact, authorise illegal murders, contrary to his repeated statements. Nothing could be further from the truth. The incident was widely publicised and debated at the time and was dealt with in Mr De Klerk’s autobiography. Although the operation was tragically botched, Mr De Klerk himself acted in his capacity as head of government with due deliberation and care and in complete compliance with national and international law. Information on the raid is set out below. |

Amnesty rules for all - by FW de Klerk
In the wake of the NPA’s decision to charge Mr Adriaan Vlok and General Van der Merwe I should like to make the following observations regarding our amnesty process.
Amnesty was, from the outset, a sine qua non for negotiations. In 1990 the NP government enjoyed overwhelming military superiority. Clearly there would have been no settlement without a sure expectation that members of the old order would not be victimised by any new government. Equally, members of the ANC and other banned organisations needed indemnity to enable them to return to South Africa to participate in the negotiations.

FW de Klerk's position on involvement in, or knowledge of, gross violations of human rights, during and before his presidency
1. Knowledge of Gross Violations of Human Rights
1.1. F W de Klerk was never the minister of a security department or part of the securocrat inner circle during the presidency of P W Botha.
1.2. The perpetration of gross violations of human rights was not discussed in the Cabinet or in the State Security Council. In as far as such abuses occurred they were authorised and managed by mechanisms outside of the Cabinet and SCC.
1.3. Non-security ministers were not informed of such activities or of many of their other activities.
1.4. After he became President, the security forces did not brief Mr De Klerk regarding any previous or ongoing operations that might have involved extra-legal activities.
